Ren Xin Wu v Lee Kuan Fung & Chua Chim Kang [2025] SGHC 63

Salem Ibrahim was recently instructed as Lead Counsel in a matter involving an experienced Chinese businessman who had invested in a Singapore-incorporated private limited company that promoted Mandarin through educational services. The core issue before the High Court was whether such an implied term, said to be agreed orally, could amount to a legally enforceable guarantee. Mr Salem Ibrahim argued that any such oral promise could not amount to a binding guarantee under Singapore law as it was against section 6(b) of the Civil Law Act 1909, which provides that guarantees must be in writing. The Court agreed and dismissed the claim, finding that the purported implied guarantee was legally untenable.

Siraj Ansari bin Mohamed Shariff v Juliana bte Bahadin & Anor [2022] SGHC 186

Instructed as counsel. Robust cross-examination by Salem Ibrahim revealed that the Trust Deed for a property was genuine and not a sham to evade Additional Buyer’s Stamp Duty (“ABSD”). Trustee challenging the trust was removed.

Phillip Avery Stanley v Mercer (Singapore) Pte Ltd – HC/OS 149/2018 (Unreported Judgement delivered on 17 March 2021)

Salem Ibrahim and Charlene Wee successfully fought in the High Court and obtained judgment against Mercer, the world’s leading professional services firm. Mercer refused to pay contractual redundancy benefits to Phil Stanley. After robust cross-examination over a 6-day trial followed by submissions, the judge found in favour of Phil Stanley and ordered costs of $240,000/- as asked and consented by Mercer together with interest rate at 5.33%p.a.

Successfully resisted applications for an injunction to prohibit the presentation of Winding-Up Petitions following non-satisfaction of Statutory Demands for US$1 million and S$400,000. Adverse party represented by a Senior Counsel.

Family
Oei Su-Lynn v Koon Boon Kin & Others – High Court Suit HC/S 1069/2020 (Judgment on 16th March 2021)

Novel case where the husband claimed that some members of his family were beneficiaries in a purported trust for certain matrimonial assets under an “Ancestral Home” agreement. The was to cause a substantial dilution of assets. The team at Salem Ibrahim LLC, for the wife, challenged his claim in the High Court and succeeded to getting orders that there was no such trust.

Lead counsel in a landmark case before the Court of Appeal of 5 judges. Successfully argued that the Family court had no jurisdiction to make orders against third parties and past cases with such orders were wrongly decided.

NICOLL HIGHWAY COLLAPSE 2004
Committee of Inquiry

Acted as Lead counsel for certifying Professional Engineer at the Committee of Inquiry which lasted 88 hearing days, involved 14 parties, 173 witnesses and 20 international and local experts in geotechnics, deep tunnelling and finite element analysis. This was a complex public inquiry into the collapse at the MRT Circle Line worksite. There was under design of the diaphragm walls and waler connections in the strutting design as well as safety errors in instrument monitoring and back analyses. A catastrophic collapse ensued and 4 individuals lost their lives.

This was followed by defense as lead counsel in the Health and Safety criminal prosecution and ensuing disciplinary inquiry.
